Governor Murphy recently signed into law the nation’s strongest Environmental Justice law (S232), but unfortunately, the enactment of Department of Environmental Protection (DEP) regulations appears months away, and major polluters are seeking permits beforehand that should be subject to greater public scrutiny and could very well be barred under the EJ Law once regulations are adopted.
The granting or even processing of these permits before the final EJ Regulations are adopted violates the intention of the EJ law and could irreversibly harm the public health, safety, and welfare of residents in overburdened communities for generations to come.
Write the governor a letter today telling him to issue an executive order that directs the DEP not to issue permits for facilities in overburdened, environmental justice communities prior to the time that DEP regulations for S232 are implemented.
